Why a Living Trust?
Property in a Living Trust does not require probate because the Living Trust owns the property, not the decedent. The Successor Trustee, identified in the Trust, can accept and sign the necessary documents.
What is Probate?
Probate is the court supervised process of identifying and gathering a person's assets after their passing and the distribution of these assets to their heirs and the settling of debts. If the assets are in the name of the deceased person only, a formal probate will generally be required.
